TERMS & CONDITIONS
*TERMS AND CONDITIONS ARE THE SAME FOR SINGLE BUILD PACKAGES AND BUILDER’S UNLIMITED BUILDING PACKAGES WITH THE FOLLOWING TWO EXCEPTIONS:
1- The Single Build Package includes a single electronic PDF file of the drawing. All required copies to be printed locally by the buyer.
This package includes the license to build the plan one (1) time.
The buyer may print up to 20 sets.
2- The Builder’s UNLIMITED Build Package includes a single electronic PDF file of the drawing. All required copies to be printed locally by the buyer.
This package includes the license to build the plan as many times as you like.
The buyer may print as many sets as they like.
**MAKING A PURCHASE DOES NOT TRANSFER THE COPYRIGHT TO THE BUYER. ALL COPYRIGHTS are retained by James Dykstra. Drawings MAY NOT be sold, given, transferred, or copied for any reason without the expressed written permission of James Dykstra. (please see the copyright section below)
The Drawing Includes:
1- Cover Sheet that shows drawing notes and highlights of the design, elevation views from all sides of the house and floor plans of each level that contains finished living areas.
2- Drawing Sheets for Exterior Elevations that show views from front, rear and both sides of the house. The drawings also show the appearance of the home with material finishes.
3- Drawing Sheets for the Floor Plans that show all required framing dimensions to locate all walls, windows, doors and cabinets for each level that contains finished living areas.
4- Drawing Sheets for the Foundation Plan that show all the necessary dimensions to locate footings and poured walls.
5- Drawing Sheets for the General Structural Details that show general exterior stud wall sections, foundation sections as well as sections through the stairs and the roof.
6- Drawing Sheets for Scaled Roof Plans that show all roof slopes, hips and valleys.
7- These home plans are fully detailed, dimensioned and designed to incorporate the International Residential Code for the location of the original design at the time the plan was created.
What IS NOT Included With Your Purchase:
1- Drawings do not include specific details for electrical, lighting, switches and outlets. All the electrical details and specifications must be discussed with, and obtained from, the buyer’s contractor and electrical contractor, and must be approved by the local building inspector.
2- Drawings do not include specific HVAC details. These details will vary depending on the heating or cooling systems being used. All HVAC details and specifications must be discussed with, and obtained from, the buyer’s contractor and HVAC contractor, and must be approved by the local building inspector.
3- Drawings do not include specific details for plumbing drainage or venting. These details will vary depending on the systems being used. All plumbing details and specifications must be discussed with, and obtained from, the buyer’s contractor and plumbing contractor, and must be approved by the local building inspector.
4- Drawings do not include roof truss or floor truss engineering. All roof and floor truss engineering is to be obtained locally.
5- Drawings do not include Earthquake / Seismic code requirements. Drawings may need to be approved and/or updated by an engineer locally to meet Seismic code requirements.
6- Drawings do not include Hurricane / Wind code requirements. Drawings may need to be approved and/or updated by an engineer locally to meet Hurricane code requirements.
7- Drawings may need to be approved and/or updated by an engineer locally to meet local building codes and requirements.
8- Drawings are not Signed, Sealed or Stamped by an Architect or Engineer. This may be a requirement in some municipalities and must be obtained locally.
9- While 2x6 Exterior Walls and 12” Energy Heel Trusses are the default for all my designs to help ensure energy efficiency, Energy Analysis is not included with the drawings.
10- Bill of Material is not included with the drawings.
11- Cost to build is not included with the drawings.
12- Site plans are not included with the drawings.
Conditions:
1- All of the drawings on this website comply with the International Residential Code. The buyer agrees to meet or exceed all local building codes and requirements for the area in which the home will be constructed.
2- The buyer understands that some states may require the Seal, Stamp or Signature of an Architect or Engineer registered in that state. This Seal, Stamp or Signature is not implied or included with the drawings and will need to be obtained locally if required at the buyer’s expense.
3- The buyer agrees to verify all materials and dimensions prior to the beginning of construction. The seller cannot guarantee the availability of any materials required to complete the build project.
4- The buyer agrees that the purchase of this plan is a license to build this plan one (1) time. These drawings in whole or in part MAY NOT be reproduced without the written consent of James Dykstra (the copyright owner) prior to reproduction.
5- All drawings are provided as-is and the seller disclaims any other warranties. The seller is not liable for incidental, special, consequential, or indirect damages of any kind.
6- It is the buyer’s responsibility to ensure the accuracy and compliance with applicable codes, statutes and regulations, and fitness of purpose of any drawings or construction information received from the seller prior to the use of the drawing. In the event that any liability is imposed on the seller, the seller’s liability to the buyer or any third party shall not exceed the price paid for the original drawing.
7- It is the buyer’s responsibility to verify the contents of any order that they place. In the event that an order is missing specific items or contains the wrong plan, the buyer must contact the seller within 24 hours of the purchase.
8- All orders are NON-refundable.
9- The buyer is responsible to ensure that the home fits on the property while meeting all set back requirements.
10- The buyer is responsible to have the floor systems and roof systems engineered to meet or exceed all local building codes.
11- The buyer is responsible to have the drawings approved by the local building inspector.
12- The buyer is responsible to have the drawings Signed, Sealed or Stamped by an Architect or Engineer locally IF REQUIRED by the municipality where the home will be located.
Licensing and Copyright:
1- All of the drawings on this website are copyright protected under all Federal and International copyright laws. Any reproduction of the plans, in whole or in part, for any reason without prior written permission, is prohibited. The purchase of a home plan license does not transfer the copyright or any other ownership of the plan to the buyer except as the limited use of the plan to the construction of one (1) home.
2- The building of more than one (1) home while using the single license is an infringement of copyright.
3- With the purchase of the drawing, the license is issued to the original buyer only and may not be given, sold to, used by or transferred to any third party.
4- Copyright and licensing of home plans for construction exists to protect all parties and it respects and supports intellectual property of the original designer. Infringement may cause settlements for damages up to $150,000.00 plus attorney fees, damages and loss of profits. Illegal use or copying of the drawings in any form is strictly prohibited.
5- The seller maintains a strict NO RETURN / NO REFUND policy. Please be confident in your selection and contact us to discuss any and all questions and concerns you may have prior to placing your order.
6- A structural engineering review of the foundation, floor, wall and roof systems locally by a structural engineer is strongly recommended to ensure that all local building codes for your area will be met or exceeded.
7- The buyer is responsible to have the drawings Signed, Sealed or Stamped by an Architect or Engineer locally if required by the municipality in which the home will be located, and the buyer is responsible for any charges related to these local services.
8- The seller is not responsible for any changes or modifications made to the drawings. The buyer accepts full responsibility for any charges for modifications to meet local building codes.
9- If plans need to be Signed, Sealed, Stamped or redrawn by an Architect or Engineer licensed locally for the project, the modified design is not exempt from the original copyright.
10- By making this purchase, the buyer agrees to all terms and conditions listed in this document.
